There's a post on XS forums saying that if you have a banned console you can check by going to Xbox Live website and clicking "request a repair" under your registered consoles list. If it's banned, you will get redirected to a page with an error saying this service isn't available or something along the lines. If it isn't it will let you go to the page where it asks you for information on what you'd like to repair.

Although the ban is inevitable; this may be a good way for people to check beforehand so they don't lose their hard drive functionality.

May not be 100% correct though so if some people that are already banned wouldn't mind checking it would be great.

My console isn't banned, and I was able to go to the correct page after clicking "request a repair".
