Getting a new modded XBox360. If I want to update a game, say in the case of a football game, where I want to get the latest rosters...

1)Do I need to pay for xbox live to do so?

2)Is it possible to get banned? I would imagine it would just take a few mins to d/l the update.

You will eventually get banned. Everyone does eventually. So who cares. You modded, you take the risk. Yes you need to be online to get the rosters.

no you dont have to go online to get roster updates. several sites have roster updates for games and all you have to do is place the roster update file onto your MS hard drive and it will work. here is one site that has updates
