Banning hardware from live = MS promoting software piracy?

After years of gaming on my PS2, I got sick of how bad the graphics were on my LCD TV and not being able to play online, so I broke down and bought an xbox 360 on ebay. Imagine my surprise when I opened my $60 Madden 10 disc, made a profile, and tried to get on the live service only to be told that I was somehow banned.

I called Microsoft, explained the situation to them, and offered to email them copies of all documentation related to the purchase. What I was told essentially boiled down to "Tough luck, sucker. Go throw more money down the Microsoft hole and buy a new console." They wouldn't even tell me why it was banned.

Obviously, I wasn't amused. I read a bunch of tutorials and hooked my 360's drive up to my PC to find I had modded firmware: ixtreme 1.6. I called MS again, explained everything again, and offered to reflash the drive if they would unban it. No luck again. I offered to ship it to them at my expense to have THEM reflash it. Still nothing.

So I'm stuck with what was a piece of hardware that was basically only 50% functional. With no support coming from the manufacturer, I'm in a weird situation. I can either say "oh, well. MS and the seller both screwed me" or I can just go ahead and pirate hundreds or thousands of dollars worth of software that I normally would have bought.

Investing in a pre-flashed drive needed to rip games looks cheap enough...Certainly cheaper than buying a new 360 and using my current one as a very fancy paperweight. I know which way I'm leaning.

Anyone else feel like Microsoft is telling people who bought consoles on the secondary market to go ahead and have a field day burning games?

yeah, whatever. suck it up and buy you a console from gamestop or wherever and and suck it up. microsoft didnt believe your bullsh*t story and neither do i. wine, wine stop crying.

I have lost all and any respect i had for this site!

Lol that was a messed up reply. But I feel for your bro. I'm lookin to buy a 360 on ebay just for backup purpose and what i do is ask every seller is if the console has ever been modified to play copied game. If i dont get a cold hard NO!!! I dont even give them a second look. A lot of people are selling their banned consoles so you gotta watch out.

Did the ebay page say anything about the console being banned or not able to be on Live? If so then it is error in your part.

MS's policy does clearly stated that when someone purchases a second hand console, they assume all responsibilty. Of course, who ever reads it.

I feel your frustration, but on the other hand try to see it from MS's point of view. If they allowed consoles to be unbanned just because they were bought through an auction site (or anywhere else for that matter), then everybody and their brother would be calling up after they got banned and play stupid, using the Ebay excuse.

Your only option is to file a complaint with ebay and paypal (if that's how you paid). That way you can start the process of getting your money back.

And you're not alone. For some good reading, hop over to xbox.com and read through the forums, in the suspension thread.
