Can this get me banned?

I have 2 360s:
-modded, this one has never been on xbox live.
-unmodded, I obviously only use this to play legit, original games online.
Using a memory card, I play on BOTH 360s with the same profile.
If I play a (unreleased) game, for example Modern Warfare 2, signed into my profile (OFFLINE) on my modded 360 and then I play a legit copy of Gears 2 (or whatever) on my other Xbox connected to Xbox Live, can this get me banned?
Since I have never played a modded game on the console which connects to live, I think I should be fine.
However, I'm not sure, since I still play on my profile.

If the modern warfare 2 save is on your account and you connect to xbox live the account will most likely be suspended. The modded xbox will also be banned if you connect to xbox live on it.

thanks for the reply. I understand the second part, obviously going online with the modded 360 will get me banned - that is why I use that console solely offline.
what do you mean with the save thing? I thought only a modded console could get you banned; how is a save file something I should worry about?

Well supposedly microsoft can detect and ban you depending on the save files you have on your xbox (not just normal game save files). That's why you're not supposed to play an unreleased game on a modded xbox, even if it's offline. Because when you go online your xbox will send that data to microsoft, possibly resulting in a ban. I would think it would be the same for your situation because your unmodded xbox is sharing memory with your modded xbox.
Bad idea if you ask me. I would keep all memory devices from the modded xbox off the unmodded one if I were you.

Ok, I understand, thanks for pointing that out guys.
But what about if I saved on the MU built into the modded 360 (the Arcade version), instead of on the memory card?
That way I would have:
unmodded 360 to play online
modded 360 with my savefile for offline
memory card with my profile which I switch between the 2
obviously I dunno if there's also information tied to achievements or something, which would then obviously link to my profile as well.

Just don't play with your xbox live account on your modded xbox 360.

may i ask a question since my question is a little similar if i have 2 xbox 360 systems 1 modded(never connected to the internet) and another to play legit games what if i use my hard drive for both systems what are the chances that Microsoft would get your console banned
(besides the fact that playing games early can get you banned )
i understand there's always a risk when you mod you system and that no one knows for sure how Microsoft catches modded systems but im just asking
i meant playing old games like crackdown oblivion not borderlands, COD MW 2 etc...

Well I do the same thing......I have played the NEW Modern Warfare 2 and all I can do is hope that they dont ban my un-modded console. My modded console got caught in last years ban hammer, so I went out bought another and just use the same hard drive..... I played most games early and nothing yet...Well If they ban me this time guess Ill have 3, I need a reason to get an elite console anyway.....Back to MW2

They won't ban your unmodded console, they might suspend your xbox live account at the most.
Btw is modern warfare 2 good?

what about if you play a copy of say borderlands on the modded box after the release date? I only have one hd and have not played any prerelease games yet. But could there be a problem with game saves after a release date?
btw i do plan on getting it, just once it hits craigslist.

Just to confirm, Microsoft do check memorycards!
I got given a 360 that was already banned, but I never went online anyway! I have 3 profiles set up on my memorycard and no Live account. Then I got an unbanned Xbox to repair. I was testing with my old memorycard, all profiles ok! Put card back in old banned console, went online only to get Xlink Kai set up, went onto Live by accident! Told me console was banned, I knew anyway! Came back out. Went to test un banned console (RROD repair) Guess what, my profile I was signed into when I went onto Live, now shows corrupt on the new machine, no savegames or achievments!! The other profiles are still ok! But my profile still works on banned console though!
Long story but thought it was worth mentioning incase someone gets banned and trys to transfer there profile to an unbanned machine!

Im using MU on banned console and HDD on the unbanned as i dont care about achievments and ill only play a couple of games online anyway so it wont matter to me, i think its better to play it safe, i mean if M$ do decide to ban or suspend you over info stored on your memory what can you argue, that you had already been banned!
