it's not illegal to mod, it's illegal to modify the copy protected FW in order to play pirated games. (your playing backups right?) it's also illegal to mod and sell for profit.

There information here at AfterDawn is just simply how you flash the firmware. There is no detailed conversations here explaining how you code firmware to circumvent copy right protections. That is all kept within the firmware team and is their business. As homesick stated, if you mod for a profit, that is illegal.

Circumventing copy protection is illegal period it doesn't matter if u state it's for backup purposes. Don't fool yourself with a false sense of security because u don't sell games blah blah. Trust me u will get busted I had to settle 2 civil lawsuits out of court witch cost me a ton of cash luckily I didn't get charged criminally but I'm on there watch list for sure and I won't get another chance if they come after me again

As manu says, profit or not, piracy or not, circumventing copy protection for ANY reason is illegal thanks to the DMCA. Technically you are breaking the law when you rip a movie DVD as well, even if it is from your home collection.

Yeah, it's stupid, but it's the truth. Don't delude yourselves into thinking that if it isn't for a profit you aren't breaking the law. You just aren't as likely to get caught ;)

exactly... said perfectly... the issue is not about backing up for yourself its about getting around the copy protection thats whats illegal so even though ur backup is legit u broke the law by going around the copy protection

He had to be doing more than just selling fw modded consoles. I'm pretty sure the second dcma violation was just the tip of the iceburg. You always see people selling modded games on craigslist and they are always oblivious to the fact that they're eventually going to get caught.

Now personally i don't really mod for financial gain but the money doesn't hurt either. I've driven to different states to help people convert their NA motor to forced induction and also added MS (MegaSquirt & Spark) engine management into a couple different cars just for the price of gas round trip. I usually do stereo/dvd/nav installs for free food/beer. I don't really see a need to make much money unless it's difficult work or unless you put a lot of time into it.

I really can't see how it would be hazardous to anyone to mod a console like that. I can understand if you do a complete hackjob repair and then sell it how it's somewhat hazardous but still, i can't imagine anyone being injured by it. Even if the xbox overheats and the capacitors blow the smell is pretty strong but it won't kill you. Hell soldering is more hazardous than that.

Whenever i list an xbox on craigslist i always get other people telling me to take down my listing because it's illegal (or at a glance it looks like it). Then when i explain to them i only mod the hardware and the firmware untouched they finally leave me alone. I think i'm one of the few that doesn't do fw mods. The point is people know that they're being watched.......

Anyway i'm not saying what they did is right (this is a life changing experience for this poor kid) but they can't let people who do this get away with it. So every now and then they make an example out of some poor sap and this kid fit the bill.
