Yes, the silver account still connects to live for updates and you can still get game demos, so they are still able to ban you.

You have to connect to Live to be banned. Doesn't matter if the account is gold, silver, copper, or aluminum. (I think platinum & adamantium accounts are ban-proof)

Do you have to connect to Live to get flagged for banning? Or have people been flagged while fully offline?
Sorry to bump a solved thread...
EDIT - To clarify, I have a virgin console... If I mod it now, keep it offline, then update to LT whenever it comes out, is there still a chance of being banned due to the initial mod? I'm assuming here that LT will be "undetectable" as c4e says.
