Do you have to play game online to get ban or all you have to do is log onto your xbox account and turn it on because XBox is connected to the internet? I basically don't have an xbox live credit at all and never play online. I do have a profile store on my Xbox, every time I turned it on, it is log into my account and I am assuming this is not XBox live right? Just needs some clarification. TIA.

You don't have to play online, your 360 will log "bad responses", so that whenever you do connect to Live, it will send Microsoft that information. With that information in hand, Microsoft can ban you if they decide that those "bad responses" came from burned games, or anything else that violates their policy.

No that's not Live. You'll see a message saying that it's connecting, and another message that says it is connected.
