Legit MW2 with Screen Tearing?

I have a legit copy of MW2 and a legit box, no mod.

I play online every night and always encounter screen tears in the bottom 25% of the screen no matter what console I play it on. Is this common among other people as well? Would installing to hard drive get rid of this?
