I have an unbanned modded Xbox 360. I downloaded a game and I patched the SSV2. Can I still play it without the fear of banning the new 360? Or will I get banned? Is it true that Mircosoft are playing another ban wave in the coming months?

As you have modded your drive, you are risking a ban already. You might get banned, you might not. No-one can tell you for sure. You can minimise the risk by stealth checking / ssv2 etc but there will always be some risk.

I personally think there will be another ban wave in November when the new COD comes out.

Example:
You and I can have identical boxes manufactured one right after the other. Have them modded exactly the same, by the same modder, live in the same house, share the same internet connection, and share the same burned games. I may get banned in a month, while you play yours for the next 3 years. It's up to Microsoft to "catch" you.

There is no science to having a console that is "safe". You can only take precautions to (as miketrev said) minimize your risk, and hope that Microsoft doesn't "catch" you.
