playing games before their release...will it get you banned?

Hello everyone, this is my first post, and probably a repeat as well.
I have two xboxs, one modded and the other untouched for playing live games. Both are slims.
My question is, if I play Bodycount before it is released(on the modded xbox) and then go play Forza 3 online(on the clean xbox), will i get banned?
Keep in mind I am moving my profile back and forth with a jumpdrive.

yes they will see that you have games saves of bodycount on your profile and they will slap you silly

When you connect to Xbox Live on the other console, details of the games you've played offline are uploaded to the Live servers. Even though MS cannot know exactly when you played the game or when you unlocked achievements, they'll know it must have been earlier than when you just connected to Live so you can be banned for playing early. It happened to people with Forza 3 when that leaked.
If you play a game early and don't connect to Xbox Live until the game's release date, they can't know that you played the game early because achievements and what not are not date stamped as you're offline.
That said, Forza 3 is the only example I can think of where people got banned for playing early - and they got lifetime gamertag bans too, which is arguably worse than a console ban.

That's true, but let's say that a game is out next Friday. You play it on your offline box today - nothing is date stamped - but then you log into Live today on your other box using the same gamertag. MS will know that you've played that game early, even though they don't know exactly when.

Getting banned from playing games before they are released is a possibility, but not a certainty.
My daughter plays everything early on her box, all the time and has yet to be banned in over 2 years of doing so.
Some people play one game early, and get banned.
My daughter is lucky I guess, but she knows the "risk" but doesn't gave a rat's @$$ about being banned. I've played a handful of games early and could give half a rat's @$$ about banishment. That my friend, is the same choice you have to make.

Thanks for the reply's.
And just for arguments sake, I picked up Deus Ex early as well. I played that probably 6 hours before its official midnight release(CST). I got through the intro without getting an achievement. I thought to myself 'maybe I could get banned' so I saved and turned off the console. 10 minutes later I played Assassins Creed Brotherhood online and have not had any issues since. So I am guessing there is no clear cut answer to my question.

The answer to your question is "yes it can", rather than "yes it definitely will". We know it can happen, cos it happened to loads of people with Forza 3, but that seemed to get special treatment cos it was a first party big title that MS had more of an interest in protecting.
I don't think playing a game a few hours, or even a day earlier would get you banned anyway, because a lot of online stores ship games out so they arrive a day or two before release date. Forza 3 leaked about 2 weeks before the release date, so it was pretty obvious it wasn't just stores posting them out early.

That depends on if he downloaded it from a site on US soil. If it came from outside the US, then the CIA will be knocking on his door.

Playing games OFFline will not get you banned.
I work at a gaming store and I bring home games up to 3 weeks early and play them offline. I've never got banned or anything.
NOW.. saying that....we all know how M$ is...they can and will do what they please with no appeal, no trial, and no chance for discussion.. They can ban you for farting too loud and just say you violated the ToS or Coc and not give any more "in depth" reasons that that.
If you do not care about running ANY risk of being banned.. then play all you wish. If you're a single console person who plays online, I would wait till street date before playing online.
