lets say you only played legit copies on live under one profile and then played backups on a seperate profile that was never used for live (both on the same console) would you still run the risk of being banned?

No one is sure how MS detects backups, so yes there is always a risk of being banned. Please search before posting as this has been answered 1000 times.
