So I have two modded consoles. One I put back to stock and the other one I use for playing burned games. I know having the other console stock doesn't save it from being banned but they have both been online numerous times since around June of 09 and haven't been banned. So if I've been moving my hdd from console to console to play burned games and then online will the one online get banned? What if I had one unopened unmodded console and was doing the same thing?

There is no science to having a console that is "safe". You can only take precautions to minimize your risk, and hope that Microsoft doesn't "catch" you.
