I have yet to go on live to see if im banned but im pretty sure i will be since 2 of my friends have been. Is there any way to keep it from happening to me yet.

If you are flagged for a banning, you will be banned. If you are already banned, well yeah ... you are already banned. Some say you can register your console on xbox.com and try to request a repair. If you get an error, you are flagged for a banning or already are banned.

This is a very common question hence there are many threads with answers, however there are no definitive answers/ban preventions, because nobody knows. In future please search the forums before posting.

My modded one's banned (got a new one and a legit mw2 :)) but its still letting me register for repair and saying I have warranty on the website until January.

Well that is good to hear, not about your XBOX 360 being banned but about being able to request a repair. For the fun of it, you should request a repair and see if they replace your console. ;)

As i read all the forums about ban wave, there is allot of theories on the banning.
1. Firmware being detected, doesn't matter which version
2. Powering dvd without it connected to the motherboard being detected. The method used for flashing with a kit or not.
3. Different games that were played that had issue
4. System is collecting data and sending it back M$ when connected to online
5. Modded Hard disk or not original OEM
6. Playing early release date games / bad rips
7. People Wave 3 only and Wave 3,4 & Activate ISO where banned
8. abgx360 error back then
9. Cheats etc
Till now i didn't read if somebody did try to used there key flashed it to another dvd drive and used it only for playing backups offline. When going on XBL swapping there original dvd drive back in the system for online play with original copies only. If this maybe would help to not get banned from XBL, but theory 4 will kill this if it's true.
Now is only a matter to wait and see what really causing console bans.
