I just flashed my 360 and I wanna know if I can update my burned games without being banned. I haven't even connected it to xbox live yet cause I'm worried...

You can download title updates from Here. Just search around to find out how to transfer them to usb or hard drive.

Well if you've been running them not patched correctly then the xbox will flag you offline and will "tell on you" when you do go online so probably not a good idea. And with new update coming looks like backups will not be such a good idea if you can get them to run on live after update.
