Will Data of Non-Stealth Game Result in Xbox LIve Ban?

Hi, this is my first post so please go easy on me.

I have a new xbox 360 with a 60GB hard drive. I flashed it myself to iXtreme 1.6 but I want to go on Xbox Live without getting banned.

I know how to stealth-patch games using ABGX360. My question regards non-stealth-patched games and the game data on the hard drive. Since some of my games are not stealth patched and they have associated hard drive data, would this result in a ban? Does Microsoft look at what is on your hard drive? And is the hard drive data of a stealth patched game any different to that of a non-stealth-patched game?

I was thinking of formatting my hard drive to remove all this data of non-stealth-patched games but then I will lose all my settings and I don't want to do this.

If a game isn't stealth iXtreme 1.6 doesn't boot it up, only in one shot boot mode, which you would have to activate. So if the game runs under iXtreme 1.6 you are pretty safe.

Xbox 360: Slim untouched with a faked 320 GB harddrive for XBL, phat with LT 3.0, played Halo early, so going on live would be an instand ban, also with a faked 320 GB harddrive
PS3: Untouched 160 GB Slim, 60 GB Fat with latest Rogero and 160 GB internal harddrive.
PSVita: hardly ever play it
GameCube: Black with a Viper chip installed. With gameboy player. Trying to get a Wavebird controller.

Rule #1: Do not ever consider yourself SAFE when you play a back-up on XBL. Stealth or no-stealth, only M$ knows what M$ can see.

What if you have game data of a back-up disk. Would this result in a ban on xbox live?

Lets say I have "Fight Night 4" which is an original copy and I play it online. I should be safe. But what if I have data of a non-stealth backup of say, "Wheel Man", on my hard drive. Will this cause problems when going online, because my hard drive has a record of a non-stealth game being played?

a common thought in the modding community is that info gets stored on the motherboard about any game you play and it gets sent to ms. so in theory... any disc that you put in no matter what will be known about by ms.

this will probably result in another question but just do a little searchin around about this. it's been talked about alot.

again though, if 1.6 will play it, without the one shot boot mode for unstealth games, then you should be fine. I wouldn't play an unstealth game if I am looking to stay on live though.

Only M$ knows. I don't think formatting your HDD is going to make a difference. Best advice I could give you is simply use your modded system to play games offline only. And never ever ever play a game before it is released to the general public. You might as well just call M$ and ask them to ban your system if you're going to do that. I personally know people who have been playing back-ups since 2006, both offline and online and have never gotten banned. I also know people who have been banned more than once. The people who have been banned were doing stupid things, like playing leaked games before the release. Does this mean this is the only way to get banned? Again, only M$ knows for sure. If you are concerned with your gamerscore then try this. Play your games offline signed into your profile. If you have another non-modded system, or know someone with one, pop in your HDD on that system and sign into XBL. Your gamerscore will be updated through XBL once you sign in. I'm fairly certain this is safer than signing in using the modded system.

I found the information I was looking for.

You can get banned for playing non-stealth games offline because the console stores violations in its NVRAM, therefore even if I removed my hard drive I could still get banned because the information is stored in the console itself.

It says here on abgx360download.com:
