We have an XBOX 360 and the controller that came with the game became defective within the warantee time frame.
I called the Microsoft tech support and they promised that they would ship a replacement.
They didn't.
So I called them back and the call center promised again that they would ship a replacement.
They didn't.
So I thought I would give posting my experience here for a try and see if anyone can offer some tips to resolving my problem.

you might want to contact the store where you brought the xbox 360 from and see if they can exchange the controller.you could also get someone pretending to be a lawyer to ring microsoft or even get a real lawyer to ring them.if they promise to replace a controller than legally they should have to.
custom built gaming pc from early 2010,ps2 with 15 games all original,ps3 500gbs with 5 games all original, yamaha amp and 5.1channel surround sound speakers,46inch sony lcd smart tv.

Id try the store you purchased the controller from first and if you have no success there email microsoft that way you have at least some proof of them responding so they cant deny they were aware of the problem if they continue in failing to replace the controller and you have to go to trading standards you can use this evidence against em.

I just called them at 800-469-9269. The recording said they are closed so I will call again in the morning. The recording also said that there is some place to check the status online. Does anyone know about that?

You know that I am not going to buy that, don't you?
Here is the latest. They made a deal about the fact that it has been months since I called them. Well first of all, I was WAITING on the shipment they promised. Second of all, my son has been playing his Nintendo DS and also SPORE on the PC and we pretty much have given up on XBOX. But since it is Christmas and since we are all tightening our belts, getting this resolved would be a christmas gift.
They handed me up to a couple of supervisors and I ended up handing the phone to my son's mom while I got ready for work.
Then I got the phone handed back to me to hear them say that now THEY wanted ME to first ship THEM the controller BEFORE they replaced it. And they said that this is how they do things and they said that that was supposed to have been explained to me in the two other previous calls.
Are they lying? I suspect they are lying. I suspect they are doing this because they suspect me.
I got pissed. I told them that a coupld of months had passed because I WAS WAITING ON THE SHIPMENT FROM THEM!!
What do you think? Are they lying? If I am going to pay for shipping the broken controller to them, they should cut me a cheque.

Maybe you need to get one of those telephone recording devices (Radio Shack) and of course calling them back and speaking to someone with a little more authority than a telephone service agent, etc. And like someone else said, send e-mails so you have a paper trail. Of course you can send them the controller and demand to be reimbursed for shipping charges. If you do ship the item, be SURE to get a tracking number, insurance, the name of the postal worker that assisted you, their favorite color, etc, etc. Always Cover your own a@@. It's the Holiday season, maybe XBox has a Skeleton Crew that doesn't know what the hell they're doing other than answering a telephone. I wouldn't expect much until after the New Year. Good Luck.

not going to buy what? that xbox.com is their website? that you should go there and check on your claim? go and see for yourself.
and why would they send out out a new controller before you sent yours to them? if this was the case, every single person that owns a 360 would be calling in saying they needed a new one because theirs broke, when it wasnt and they were just to cheap to spend the 20 dollars on ebay for a new one.

xbox.com is where you can check the status of a pending repair order.

No, they are not lying. It's standard practice to accept hardware for repair. They're not going to just send out a free controller to everyone who calls. However, they should have given you something along the line of a reference number to include when you send in the controller.
