The only lawsuit I've heard of was in Australia, a man was sued for damages & loss by Nintendo when he uploaded New Super Mario Bros Wii to the internet in Australia before it's scheduled release there. I don't think Nintendo can track down individuals via the internet, though.
Unfortunately they can, your internet service provider has to keep records of everything you do! The US is now trying to get the EU to give them all these details (without a reciprical agreement of course).
If you are on a torrent site YOU are also the uploader, therefore they can come after you just the same. In the real world they are after the release teams and torrent sites, they leave the small fry to your ISP, if you ever get a cease and desist notice - don't ignore it, just cease! Your usual punishment is going to be restricted internet speeds or cut off!
I got a Cease and assist pop up when I tried dl a movie. It would not go away, everytime when i would start up BOOM there it was in my face, I couldn't ignore it, close it, do anything. My only option was to either select DEFEND YOURSELF, or Wipe out everything and reinstall my whole PC. I was a scared little boy that day.
