You might want to also try a different DVD.
It has always worked for me.
If a DVD has problems with the subtitles, you might have to manually extract them.
You can use VSRip to extract just the subs directly frmo the DVD(simpler than creating the SRT subtitles):

nu2ad : I'd like to know what your converting to DVD 1st
R U RIPPING or just converting [ AVI, MKVs or even WMVs what]?
The simplest way is to just use ConvertX
If its an MKV ConvertX will give U selective Audio & Subtitle
If it's an avi U can add the External Subs
If it's a ripped DVD, anything will do...CloneDVD, DVD Fab, DVD2ONE, Rip4me, on and on and on
HAVE U TRIED MakeMKV

@ rick5446,
thanks for chiming in but all is well now.
cyprusrom stuck it out with me and i was able to get exactly what i wanted - i learned that with handbrake i can back up a DVD WITH subtitles all bundled up in the container.
and yup convertxtodvd sees them no problem.
