Swap Magic itself is legal but what people use it to do is sometimes not. e.g most people using SM use it to play backups of games they already own (which could be illegal depending where they live) but isnt that bad. Its the people that use it to play hired then copied or downloaded games that are classed as pirates. Of which is illigal.

Bah, even the topic of backing up your discs is in question. For instance, some people don't even want us making legal backups.

Why is piracy so prevalent? Easy : ridiculous game prices.
No one's willing to pay $50 for a game they're only going to play once. I think the majority of pirates just copy games, play them, and pretty much store them away. Any game that people truly want, most will just BUY.

However, $50 for a game is just too much. That's why I bought a used copy of GT3 and still haven't bought GT4.
