I have a lot of games that cant be booted by swap magic cd and are pretty much the biggest dvd-5 games. my question is, can i use a dvd-9 game as a toc refresh disk?

No, most DVD9 based games don't include the 2nd layer in the TOC. For example: Devil May Cry has a bigger TOC than Metal Gear Solid Substance or Xenosaga.
