think i finally found what works for me and thought i'd post it on here in case anyone else was in my shoes. this seems to be the easiest way to go... any other suggestions more than welcome.

when using mpegs in excess of 2gb make sure your drives are using the NTFS filesystem (thanks seamonkey)

1. started off with a downloaded divx
2. stripped the audio from the divx using VIRTUALDUB, saved as seperate WAV file
3. used TMPGENC to create mpeg2 from divx and wav
4. used SPRUCEUP to author the dvd, set output to "title set"
5. used nero to burn the title set as dvd-rom(udf)
