Backup - Modded - Action Replay

i have a question about the action replay.
i use an modded PS2 and backup DVD work fine with them.
but each time i try using the Code menu, the backup is refused.
i have seen many thread about this trouble and it seems that Swap DVD and DVD loader is the solution.
i try using this solution but it doesn't seems working (certainly my mistake...) but what i don't understand is why the action replay doesn't work with backup even when the PS2 can read them ?
is the Swap DVD and DVD loader the only solution, even for modded PS2 ?
