on a closing note.
I managed to flash the benq drive
Purchesd a flashed samsung drive to rip and pioneer 115d to burn using xbox backup prog - xbox creater wasn't compatiable with new sata card so i installed rom and dvdr into my mainpc with onboard sata, burned2.4x (xbx creatr on Verbs and at 1am this morning tested and all worked great. Xbox plays origs,bkups etc no problem.

I'd like to thank everyone for their help and advice. I can now let my 4 year old look after his own game disks lke his movies!

I know i can play backups but never online to keep my live connection.
I should be still be able to go live with my origs though without getting banned, fingers crossed. i dn't really use live much anyway.

you will still get banned even if you play originals on live only. it logs what games you play even when your 'offline' and as soon as you sign into live, it sends all that information to MS, so eventually your time will come.
