The following comments relate to this news article:
article published on 5 March, 2011
A federal judge has ruled this week that Sony can subpoena the Web host for George 'Geohot' Hotz's website, and acquire all the IP addresses of anyone who has visited his site in the last 26 months.
Furthermore, Sony also won subpoenas for data from YouTube, and for Geohot's Twitter account.
Sony has accused Hotz of violating the DMCA by publishing a master key for the PS3 that allows ... [ read the full article ]

There's another step they'd have to take if they wanted to find out most people from the IP address logs. Except for those w/ static IPs they 'own,' they'd have to get further court orders for ISPs to identify the actual users of those IP addresses at any specific time, which is generally harder to do unless they can prove to the court(s) it's absolutely necessary.

I think for the people who they are looking for they have their IPs already, they just need to prove they were connected to that server.

I'm no $ony fan but I really think they might just want to show where the people who recived the info are from so they can keep the suit in San Fran...Of course they can't sue you for watching a video or visiting a site...less you're talking kiddie porn...

Quote: Sony was given the subpoena rights for two reasons; one to prove that Hotz "distributed" the hack and the other so Sony can prove that its lawsuit in San Francisco will not have to be transferred over to a court in New Jersey, Hotz's home state. Sony says seeing the IP addresses will prove that a significant amount of the hits were from California compared to New Jersey, so San Francisco is a more "proper venue."
Seems a few people need to read the post before commenting, this has nothing to do with bringing lawsuits against those who visited the site or even hacked their ps3, it's so that sony can have the trial in their preferred court room.
Don't get me wrong, I wouldn't put it past sony to bring lawsuits against users eventually, but that's not what this is about.

I saw that and I see where you getting at. The only thing which I am having trouble understanding is why they needed the physical IP addresses? If they wanted to know the geographical location they only needed to supeona the web hoster to submit the information similar to how a bank would divulge personal information pertaining to a client if supeoned. They went straight to the vein and we all know that those IP addresses will be retained for later use.

the only reason sony would need there I.P addresses is to hack the peoples computers or track them down for possible future court appearance.

So what are they going to sue ME for?
Because i was interested in what they did? It's not against the law to look. And my lawyer is family so they better be ready for all out war at no cost to me if they dare subpoena me just for looking.
Also I've been a long time supporter of boycotting Sony. I bought my PS3 at a pawn shop used (no money to Sony) I buy ALL my games used (no money to sony or developers) I buy all my peripherals used too (no money to sony) It sucks to wait and buy a game months later used instead of at launch...but i think they've way overstepped their bounds and i refuse to support them.

They probably just want to count the number of unique IP addresses that connected to the site to figure out actual traffic and other similar stats. But yeah, they can't do much else w/ the data w/o asking ISPs to ID the actual users of the IP addresses at the specified times, which again, the courts are far more likely to not approve requests for unless there is a demonstrable need. The IP addresses and server logs are far more generic information.

What does the geographic area where the most hits matter? I'm confused on that. If Geohotz is in Jersey, and did the hacking, uploaded the info and basically committed the crime there, shouldn't that be where the case should be pursued?
If just based on hits, what happens if the most hits came from Switzerland where companies like Sony have no power? Then what? That doesn't make any sense to me really, how can Sony get the right to decide where to have a lawsuit?

Sony has every right to sue Hotz, and has the right to obtain the IP addresses of those who visited Hortz?s website.
To see why I am right:

Another newbie account spamming the board. This is another obvious Sony made spin account. I'll tell you what vintagesax88 you tell us why Sony shouldn't be sued for removing OtherOS?

The sad part is that this troll is somewhat half right. The only reason I even jumped on this thread is because I used to deal with intellectual property issues from various companies digital and physical and I have great interest in this case. Vintagesax88, you can't just say he violated the digital rights act without specifing what the exact violations were. The act is very broad and is broken into sub sections as with every other law. As far as it being constitutional, that is another debate. This is taking this topic into another area but no doubt Sony is chasing after infringments under the DMCA to nail GeoHotz. Technically how Act is written this scenario could fall under the DCMA but so could EVERYTHING else that comes to modification. You just rooted your Android phone, violation. You just popped open your Cisco router and extended the range, violation. You just modified a couple of desktop program which you were not the content holder, violation. I still do not believe they had the right to grab the IP addresses on the basis of a court venue. This is the same as asking a company to give me the social security numbers of your employees so I can see how many are female.

"What does visiting a site or watching a video going to prove?"
To me, it proves people are interested in what can be accomplished. I visited the site in this period. Unfortunately for BLOny, I no longer own their console and accessed the information purely for informational means. Is curiosity criminal when it comes to their tech?. Aside, what abt their root kit they installed on so many computers, part of the BMG debacle?
Good luck, geohotz. Don't forget your coat"

Sell your PS3s and do away with console gaming and move on with life. I lived a long time without the current generation consoles. I sold the rest and kept my 360 (because it is a JTAG). But I hardly ever use it.

hey, what happened to the recent court case where apple couldnt restrict owners of there products to only there software, in tern making jailbreak ok.
I always thought when you buy a product its then yours to do with as you please, are we just renting from these companies?
And yeah i detest sony, i would never buy any of there products, they have lost sight of whats important, and there global image is, in my opinion, now of a money grubbing, sneaky, ethically challenged company. They would walk over there dying mothers to pick up another dollar.

Sony paid off a Judge in Cali to give them the OK on this ridiculous IP fishing adventure. Sony now has to find a way to manipulate these records because they want to make sure the case goes to trial in that judge's courtroom since they've already paid for it.
We've had how many Supreme Court cases now ruling that the distribution of information, even information about a crime, is legal and protected speech? Sony has no case; they're simply using their money and power to punish Hotz as much as possible. He'd also have to travel to CA to defend himself.
Standard evil corporate behavior- if you can't win have your legal team bankrupt the opponent.

Done I will be boycotting ALL $ony products, as soon as both of my vaios go caput, I will never buy that brand again. I haven't purchased any of their products in about 4-5 years anyway. Even though I own a couple of PS3s I believe once you purchase it it is yours and you should be able to do whatever the hell you want with it. WHATEVER you want!! And that company should not have any say so. I think I'll be reading the fine print next time there is a product that might do this same BS. It's like saying when you buy a car you can't put anything or take off anything because the company would be suing you. F'N ridiculous! I personally don't play any homebrew games, and never bothered to install LINUX, I thought that it was a sweet option to be able to do that. In the end...it's all about money. I'm sure this Geohotz guy wasn't selling anything made by $ony and trying to pass it off as his and make a profit.
F $ony!!!
Oh, and I think it is a violation of my rights that when I purchased some games I was forced to upgrade the firmware or else was not able to play the game that I legally purchased. I should have sued $ony for not placing a disclaimer on the game saying that I would need to upgrade my firmware in order to play it. Had that been the case, it would have had an impact on whether I purchased the game or not. As well as a lot of other people. But oh well, $ony and their products will serve my purpose for as long as I want them to...and then they will just get trashed. I guess that's the only good thing about consumerism.

Coming from someone who has a love of modding things, car, computers, general tech and also think that once you have paid for it, YOU OWN IT.
Take for example a car, under sonys take on events it would mean.
NO AFTERMARKET MODS, no K and N, koni ,etc
If anyone did find a way to make an after market mod actually work, a service update would be issues and you wouldnt be able to take the car on the road again until it was applied.
On top of that when you bought the car you were told it was 2 wheel drive and could be switched to 4 wheel drive at any time, most people never used 4 wheel drive, some did. Then yet another service update was applied that removed 4 wheel drive mode..
Really if this was anything other than a games/console/electronics no one would stand for it... and i cant belive sonys getting away with it.
Staying with the cars, a mate recently got a new scirrco and had it chipped, first one in the uk to be done as far as we knew at the time. VW made it pretty hard to do, but eventually it was hacked, you dont see VW suing him to the stoneage for getting root access to his ecu so it could be reprogrammed....
SONY YOU SUCK D0NKEY C0X, and your playstation move looks like to lolly pops and should be dropped before you have to dig its grave.

Apples and oranges... If you're planning to poison the president or involving in fake painting heist, then yeah. Of course, you have every right to boycott Sony.

Calm down, if you done nothing wrong, you got nothing to worry about. Like the other guy said, if you watch a cooking video and you're not trying to poison the president, then what's the problem? Why are you being so paranoid? Boycott Sony seems to resolve your problem too.

Yes, you can... If you're important enough or have enough money to buy your way.

Sony did that to the hackers already, they took the PS3, computers... Hmmm, I don't think Sony is being cowardly and last time I checked Sony still have tons of money.

Didn't I buy the thing and am I not allowed to use it how I want?
Of course you can do whatever you want with things you bought, nobody can take that right from you. It was unthinkable just few hundred years ago that you can buy slaves and screw them whenever you want, forget about guns, cars, jets... What make you think gadgets can't be next? Just because you pay for it, it doesn't means you can do whatever you want it. It simply means you can do whatever you want within the "laws." And who makes the laws huh? Not you and me, but people with money... But yeah, it's you and me make them rich.

If you do not agree with this fascist crap, DO NOT PURCHASE A SONY PRODUCT. Vote with your money.
You're stating the obvious... But yeah, I like to point out that voting with your money only counts if your money can be SEEN. Capitalized to emphasize visibility...
