Hi everyone,
Basically I have an idea, but i need your guys opinion on whether it's legal. My idea is to back up games as a service, providing that the customers MUST own the original to order a game. I would run this through a mailing list rather than through a website. Many people do not have the equipment or know how to back up their games, so i think this would be a good service to have. But my main question is, is this legal?

no, most people will lie about owning them
also, it has to be a backup of THE game you own, not a version of it

Well it is legal, has long as you have a disclaimer stating all this stuff. I know acouple of people who do it, yet jpp01uk is true, most people who order will not own the games, lol.

there is one way around that. Make then send you their original disc, then you can mail it back with the back up. Then there would be no question.
Otherwise you would have to have every game in the world there that someone would want a back up of.
And a disclaimer is a must, they should have to sign and online disclaimer before you even sell to them.

I've seen a banner add at the top of the forms that advertises exactly that which you want to start doing... i'd suggest you find the site for it, read their disclaimer and see how it's composed. Anyways, good luck !

I have been told the customer service is bad on most sites of this type, so that is my aim, better customer service. Thankyou for all your advice, it has been extremely helpful. I've decided to proceed with my plan. I want the disc's to look proffesional, so i guess that means an epson r200 to print direct on the discs and some glossy paper for the covers.

Just a heads up on the labels. The epson R200 is a great disc printer but make sure to buy the dvd's with a printable surface. I had many issues with disc's not playing after I attached a label. Make sure to get disc's with printable surface all the way to the hub also to make it that much closer to the real thing.

Don't forget p+p..
Also.. you will make no profit from it, and if you are then it is deemed illegal..
If you are thinking of running a business like this, I reccomend you move to Canada or something.

An advance warning: the UK has VERY strict rules when it comes to copying video games and such, so i'd really make sure it's ok to distribute such backups, and make sure you have some legal counsil.

I guess this is gonna be the big problem, sony have already succesfully banned the sale of modchips over here. Perhaps i could lie and say i am based in Thailand or something???

how will that work? you need it to pay into a bank account etc, which is all traceable

You could try passing it off as though you're based in the netherlands, the rules here aren't half as strict, and the only copying they seem to really target here is dvd's and audio cd's, and only if it's on a Very large scale...
