I can only access the hacked dash when splinter cell is in the tray, and when i remove it from the tray the hacked dash closes. i think this is because the ms dash is it is taking 'privilage' over hacked dash when a tray is opened. if so how can i remove it? or pherhaps make hacked dash default 1 to load without splinter cell needed in tray.

Sounds to me like the dash wasnt installed properly, or the type of mod you have thats what its suppost to do.
What did you use to install your mod?

I used the SID installers for splinter cell, the same ones used in that amazing tuorial. http://forums.afterdawn.com/thread_view.cfm/311710 It was working properly before i patched the ms dash in so im thinking if i removed it it may work properly again.

Logik is right, "Sounds to me like the dash wasnt installed properly", you should try to get your hands on an ORIGINAL xbox game that is online enabled (i used NFS: Most Wanted) and go into the xbox live section of the game, it should automatically update (re-intall) your dashboard...
P.S. - you dont need to have an account with xbox live, and you dont need to be connected to the internet on ur xbox either.. All u need is your xbox and and an original online enabled xbox game...
After you have installed your MS dashboard, and your xbox is stock agian, try this tutorial on soft modding your xbox... http://forums.afterdawn.com/thread_view.cfm/311710

what did you patch the ms dash with? A retail game? or the softmod installer? This should be an easy fix. first patch your ms dash with the Mod installer (not game, srry CJ :)
When done giver a reboot and see if the mod dash comes back. if not simply re-install you mod.

I used the option on the softmod menu 'patch ms 9580' or whatever number it was.

hey all i accedently removed my ms dash board and when i turn on my xbox it says error 13 on the top of my screen is ther any way to get my dash back please help!!

do xbox still load original games? if so try to play new games which has dashupde like gosht recon. Then look for dashupdate. It may reinstall the ms dash.
You can also load the SID or AID to see if it helps.

yep it still plays games where in the game do you find the dash install????

try to load AID or SID or games. Try to go LIve, you can find the dashupdate. Dashupdate just shows up or in options
