Hi

Just modded my 360. Hitachi drive, used the xecuter usb connector. Went like a dream. Played a few back ups BUT.... I have loaded Splinter Cell and it wants me to download an update for xbox live... As of yet I have refused. Has anyone downloaded it and given xbox live a go?? Sorry if this has been covered or is old news but this is my first visit to xbox live with modded 360 + splinter cell and I'm not looking for a ban. : )

I'm guessing haven't played a new game since the spring dashboard update on that 360. The game didn't ask me to update. I played it with Live going no problem.

i was playing an orginal Madden 07 and it ask me to update and i did. didnt get ban.

You won't get banned. Those updates are updates for that particular game. Not dashboard updates. Trust me, you will know if and when a new dashboard update comes along.
