they wouldn't do that because we have all legal right to back up our games

they banned modders of the original xbox, didn't they? why would they hesitate to do so with the 360s?

Actually yes do have the right to physically alter the console itself. for all MS cares, you can turn it into a fishtank or a snowglobe. What MS DOES care about is modifing the console's firmware, bypassing security measures.
MS banned Xbox modders before for using modchips which altered the Xbox's hardware to bypass security measures to allow backups to be played. MS also banned Xboxs found to be running unauthorized firmwares, again since those firmwares are used to allow the Xbox to play backuped discs.
you dont see MS banning Xbox360 users that have painted their Xbox neon green with pink poka dots do you?

Dont get me wrong, Microsoft WILL eventually start banning certain firmware version guaranteed. They did with the original and they will will this, the trick is staying on top of the firmware revisions, thats all.
The people that had E66 error issues on the latest dashboard update were running firmware versions that were a couple revisions old. Once they upgraded they were fine, no E66 errors anymore.

What you people are missing is if MS could ban firmware modders without screwing over non-modders they would have already done it by now. Maybe after 2 years of no bans people will stop saying the bans are coming.

Wouldn't Microsoft also think twice about banning the firmware mods? I mean, it's not costing them in any money is it?
They want to beat the PS3 when it comes to online, and if they banned all the people using firmware mods, wouldn't they just be losing a lot of subscribers?
If you stay on top with the firmware revisions, does that mean you'll be able to always play backups online as someone will just release a new version as MS releases a new ban?

Well now that all depends, it worked in the first round of E66 errors, but who knows what they put up there sleeve down the road, I think only M$ could answer that one. :)
