As of Late I've been hearing rumors about trying to shut down Kazaa and that people are getting sued or even arrested for downloading songs and pornography, I mean I can understand why the people who download the child pornography are arrested ( Not sure if that is true either ) but just for d/l ing songs, can anyone enlighten us on the current kazaa situation.

ANY INFO WOULD BE MUCH APPRECIATED! :-)

I think what is happening is that the RIAA is litigating people who upload songs(somebody correct me if I'm wrong).

Seriously though, it is quite a big joke! I also live in Canada so I am not too worried about them coming and knocking on my door, but if the RIAA ever knock on yours, give them a personal message for me. O.K? It Goes Like this.

Downloading "illegal" files is not against the law. Remember that.

Only uploading "illegal" files is technically illegal. And even that is being challenged. The current lawsuits will be tied up in the courts for years.

Well not exactly!! Downloading music is illegal i believe in America (DMCA) and in some of Europe (EUCD). In Finland though, u can download whatever u want, but sharing is illegal!

In the United States, the DMCA forbids *knowlingly* accessing files to which you do not have copyright. No court can, by the vary nature of the US legal system and based on previous cases, find against a user who has relative proof that he/she downloaded a file, was notified it was illegal, and then destroyed the file.

Let's say I compose music and I give you permission to download and of my songs. You download the file "PlusOne - My New Music.mp3" believing that, because I said OK, you have legal access to the file. You play the file, only to find out that it is really a RIAA artist, and that it is copyrighted by the RIAA! (look aghast). You immediately destroy the file. >> In this scenario, you would not be convicted of any crime.

You can take this theory even broader... it would be possible to say that even if a file says it is, say "Usher", it might not be the RIAA Usher (as was seen earlier in the Professor issue). You could still download the file, and you would be "legal" if you "immediately" deleted the file.

This leads many lawyers, including the EFF, to state that downloading files is not technically illegal (or atleast not punishable), however uploading the file is. Some lawyers have said that in order to get into this loophole, you would have to delete the file in 24 hours or less -- however by using a disk wiper/eraser you could destroy the file headers and thus the record of when the file was deleted.

Essentially, it is assumed that when you upload a file you are knowling dissemeniating (sp?) illegal files, and that is why the RIAA has been going after file **sharers**. Currently, most professional believe that the RIAA is targeting SuperNodes especially. To my knowledege, no lawsuits are pending against people for downloading files.

They shouldn't care anymore. There are more and more people out there doing illegal stuff than d/L songs. Don't modchips ring a bell! I kno their is a law that defends it but u don't see sony selling modchips in your local game store. So people really don't care anymore. People are still gonna buy music cds and people are still gonna buy videogames. Nothing is gonna make company's lose money. Even if they take KAzaa off they will just make another program. Well they already have other programs. Wen Kazaa is gone i'll just d/l imesh and so on. Tats how it iz.

It scares me how naive these people in power (at the RIAA and etc) are about file sharing. There are so many execs out there that actually think that file sharing is something that can be stopped. Clearly, they know freakin' NOTHING about technology or the nature of P2P sharing. As long as there are computers, there will be a way for them to connect together and share files. It's unstoppable and to think otherwise is being incredibly ignorant. What I can't understand is why companies haven't accepted this and tried to capitalize on it. I suppose some already have (MP3 players and such) but this is an untapped resource that could really make someone a lot of money, but these anti-file sharing companies have their heads too far up their asses to see it.

exactly, just be careful and thats fine! they arent gonna come to your door, kick it in and grab your computr! See thats their problem, they say ppl wont walk into a shop and talke a cd and walk out, well they wont walk into anyones house and take their computer and walk out, they are hidinmg behind computers and the law too! I wanna see a war, im serious, our internet privacy is being threatened and that cant happen!
