My understanding is that with the previous versions of iXtreme the firmware would not allow the backup to boot. But it's been found out that even though the firmware wouldn't allow a non-stealth backup to boot, the stealth (or lack of) info was still being uploaded to Live if you were logged in.
This new firmware blocks the stealth info from being uploaded to Live if booting fails.
Now, it's still up in the air if non stealth info is being logged by the 360 when it's not connected to Live and uploaded later when it does connect. But I can say this... I've played many non-stealth backups. I did have my cable disconnected but played under my Live gamertag and I've yet to be banned. When I was logged on to Live I only used 100% stealth backups. And, up until yesterday, I was using 5.3c.
*** Important *** If you're using the older iXtreme firmware, don't use your 360 to check if a disc is stealth and be logged in to Live at the same time.
I'm on ixtreme still 1.0. I just been making sure to check everything with the last xdvdmulleter 1st. I'm glad I've been doing that after read this little bit of news. Still how could the ban you for a backup that didn't boot? It would be like banned a non modded 360 that had a burned game put in it.
