it can be done dcepending on what drive it comes with, so far i think it comes with either a Hitachi 78 or 79 which are both flashable or a Benq which is just about flashable if you have the know how.

Downsides to modding it? non that i can think of unless you brick your drive in the process of flashing it. If you then burn games on cheap media this could wear your laser out early.

that is a chance you will have to take. at the moment you can play on line (i have been using live for over a year now with a modded box and playing backups) but who knows what will happen with the Autumn dash update. may be another wave of banning like the spring update.
