hey if i get halo 3 back up and play it now will i get banned , i wont connect on live take all cables out is there a chance i still could get banned ?

No You wont get banned, because some store broke the street date with halo 3.

but that my console is banned anyway i could careless. (no not with halo3, but thru halo 3 beta)

You don't need to worry about playing the Game before the Street Date! You won't get banned for it! M$ announced that they won't ban people for playing the game before the Street Date, but they did say that they would Ban Employee's if they play it!
