I am planning to get the new premium setup with HDMI connection and want to know if there such new DVD drive that cannot be moded. I read a lot about the Samsung and Hitachi. I'm just afraid I might get something different with the new system. Should I just get a used system with a mod-able drive? I am just worry about the life of the laser with used system.

The BenQ is the drive on the new systems, they are not moddable yet, but may be soon. Also, the Hitachi 79's are a bit more difficult to mod. The laser's are not terribly difficult to replace if that ever became necessary.

don't buy anything used because you have no way to tell if it is a console banned from Xbox Live.

Unless you go through Gamestop. The manager at the one near me said they test and guarantee all the systems before they sell them. Other then that I would buy new.

If a system is banned from Live, will it even allow you to browse as in the case of Silver Live? A friend told me w/ Silver Live, you can access score board and such. For that I can test Silver Live to see if a system is banned before I buy (in regard to CraigsList sellers).

I don't know much about Live. I assume all non-Gold Live boxes have Silver Live.

If you go the craigslist route and you are testing someone's system, just try to recover your gamertag to log onto live if they don't log on themselves. If the system is banned it won't let you recover it.
