to my understanding MS centralized servers have to send an request packet, before the Xbox will send back an acknowledged packet .
the Ack Packet could contain anything related to your Xbox.
the Req packet could be anything related to the network.
it would go something like this.
Req: Ban flagged
Ack: 320 Xbox are baned
So if we wanted to ban someone there Xbox would have to be flagged. hence why on rare cases someone will get banned that had done nothing wrong.
a flag can happen for reasons unknown to us. a bad game disc that you bought brand new can do it. a short in the console can do it.
there banning system is not state of the art stuff. would you want to scroll down a list of 500,000+ xbox and find the one to ban.
most bans are automated, so are the requests sent.

thank you for clearing that up. i kinda felt like a idiot because i am a net admin and i couldn't find it.. this sems to be the most accurate forum i have found so far. most forums make outrageous claims about the formware is what gets you banned and its a "hidden transmission that cannot be detected using a packet sniffer" **chuckles**

there very much detectable, and usually happen around the begging of a new month. you could wait and take the performance hit of running a sniffer.
its not like the information there is helpful, just a Mac address/and S/N of your console to be baned if worst come to worst.

Correct. There is no way to play with the possibility of being detected.
Quote: but if you have the original, you can play on your modded xbox 360, with no chance of getting banned. The only time you should play a backup is when you aren't on LIVE.
Well, we can't say "no chance". When you use an original, the modded firmware works just like the original. It is believed by C4E, Opa, and some others (these guys developed the modded firmware, so they'd know best) that MS is not able to read the drive firmware due to how the hardware was developed.
And that seems pretty feasible. If they could detect the firmware, everyone would be banned. But then again, no one knows what MS is working on now towards future detection.
So as it stands, if you have only one console and it has modded firmware, your safest way to play on LIVE is to use your originals.
"Correct. There is no way to play with the possibility of being detected."
...Wtf is he talking about... first he said that you will probably get banned... now he says that "... There is no way to play with the possiblity of being detected...", hypocrit at all?
Another thing, where did you find the information in the first picture... to me this looks a lot like the old xbox logo... out of date at all? Also, you have no way of verifying these alligations; you don't back up your own games, you don't work for MS, you don't have a clue!
The owner of a highly regarded modding store in Australia said that none of his customers have reported being banned from xbox live after having modded their xbox 360. And he (or anybody else for that matter) has no idea why some people get banned an some people don't.
So before you start saying stuff (especially on a forum with such high traffic) maybe you should get your facts straight.

I don't mind a debate at all, but Chris seems to be a bit aggressive. Relax dude... you don't have to put the guy down. :)

Well, here we go again with another one of these guys.
First off, your first quote was a typo and was fixed. If you couldn't figure that out on your own, well, I'm sorry.
Secondly yes, the pic is of an original Xbox game. But I guess you were too lazy to look at an Xbox 360 game and see it uses the same bar code. And what do you mean by "you don't back up your own games"? Who are you to tell me what I do and do not do?
I really like this comment from you the best: "you have no way of verifying these alligations". I'm discussing how it's not possible to make a 100% true backup on to recordable media, and you say there's no way to verify that. You're kidding me, right?
And then you go on to say "The owner of a highly regarded modding store in Australia said that none of his customers have reported being banned from xbox live after having modded their xbox 360." Yes... I'm sure the guy who makes a living on modding consoles and who's income would be affected if he did tell customers that consoles can be banned should be trusted over what others say.
Yep... you sure got me there. :/
Needless to say, we see your type around here quite often. After the next ban wave you guys are the ones to join forums just to shout how it's so unfair for MS to do this, how the guys who made the firmware are complete a$$holes for getting your console banned, etc., etc. You're the type who think that just because you haven't been banned yet that means you're perfectly safe.

Excellent thread! It answered almost all of my questions. :D I do have one more question. Apparently, the question of is it the backed-up game or the firmware that gets you banned from Live hasn't quite been answered, so I want to ask this, if I log onto Live with a modded box(and an original game in) and try to use MS points, will this send a flag and get me banned? I ask because I have some points I'd like to finish up and want to download a few things, mainly songs for Rock Band. Other than that, I RARELY use Live and would just keep my box disconnected.

No you cant get banned from signing in with hacked fw alone. you have to be using a bad backup to be detected. so hacked fw+retail games on live is just fine. Using your MS points on live is just fine. I have purchased lots of stuff and i have 2040 points to use myself and i cant decide what to buy LOL
just to ease your concern I can say I purcahsed GTA IV expansion lost and the damned the day it came out and i have hacked FW and i was using a backup of GTA...that was a few months ago or so
If you send me questions on Live about modding or anything related i will block you. Dont be an idiot.

As long as you don't play your backups online you should be fine,
but then again it doesn't really matter if your offline or on, flags can still happen, thus the moment you hook up your Xbox the mighty hammer of Thor, may smite thee.

just use abgx and you wont have to worry either way plus dont play games early. I have before but only 1-2 days early since copies get leaked from stores and gamestop employees rent out their own stock i figure if its stealthed then its ok
wouldnt a bad firmware flash not even play a disc? and if so then why would you hook it up to the net anyway.

Thanks. I'll have to download ABGX. I haven't tried making backups of any of my games yet.
EDIT: another quick question: I just acquired GH Metallica and it has the .dvd file in the folder already. Does that mean it's been "stealthed" already?

just dont say you downloaded but acquired
.dvd file can be incorrect abgx will check and correct or create a dvd file if there is none. dont ever take the word for it if it says it is stealthed already. scanning with abgx takes 5 mins or less so it is worth it.

Oops, my bad. Fixed.
First thing I'll do is get abgx when I get home.

This question is for people who have experience with playing backups online and who have been banned at least once and who know other people who have been banned. From your experience and what you have heard of other's experiences, what would be the expected time of lasting on xbox live using backups that have been ripped to near perfection? Is there a less chance of getting banned when using an older xbox or is there nothing that would indicate this? Thanks.
