I had to buy a new console because I got nailed and banned from live , I was using xtreme 5.2 at the time and I did'nt have a chance to update to ixtreme . My question is , If I update to the ixtreme on this new console ,what are my chances of getting banned again ?

Same as it was before. If you mod you can get banned. One thing it will stop is the use of all games that have not been properly made (stealth copies) as iEtreme will not play them.
