There really isn't anything you can check, the best kept ones can die the RROD suddenly so you just don't know. I bought a broken one off ebay (rrod) and it had not been registered and got it fixed for free (allowed by MS). I would do that, I took back the new one I had just bought.

wouldn't i need to provide microsoft with a proof of purchase or upc code?
Nope. You would have only if it has been registered before the first owner and you would need to verify the previous registered person's name and/or send the original receipt in. Mine had not been registered so I just called and registered it (this is perfectly allowed by MS so not breaking rules). Keep in mind though you will get a year old or so refurb back, and you will need a power supply, controller, av cords, and harddrive so that's money there too.
