In the nintendo channel when you enable the ds demos nintendo makes us agree so they can track our gaming times (the ones who appear on the message board), etc. Does that means that if we play a homebrew channel they can see it too?

Apparently yes but I don't think they would care at all. If you are that paranoid then just don't use the channel. I still will though.
