hi, just want your advice, I list my nintendo wii with loads of backup games but someone emailed if we could swap with his psp with 15 umd games but after 4 days we swaped he emailed me that the wii is not working properly and he want his psp back or he report it to ebay and police. any opinion?

we didnt complete the transaction on ebay though, we met somewere and made a swaped.

he can report it to ebay and to the police but there will be no effect. It was his responsiblity for this fault if you guys met. If you listed it on ebay or craigslist, etc saying it works then yes he does have the right to have a refund or an exchange back. technically it his responsibilty not reading everything carfully if you listed it as NOT WORKING and he cant report you.

Where they backups or pirated games? You can only call them backups if you own the originals.

The Police wouldn't do anything about the transaction itself since it was a private sale. The only issue that might come up is the so called backups (more then likely pirated games). Technically he has what they call unclean hands so he as well could be prosecuted if they felt like prosecuting for the copied games. So reporting it to the Police could be a dumb move for both you and him.

As for Ebay if he did not win the bid or you canceled the auction before it was over there really is nothing they would do. The worst they could do is ban your account if they feel you have mislead him.

Did you give him a working Wii? If so I wouldn't exchange it back. Who knows what he could have done to the Wii after you had made the exchange.

If you didn't give him a working Wii and told him it was working then I hope you do get in shit.

I agree, if you sold him a fully working wii then tell him "tough luck", its not your fault. He can't do anything without incriminating himself.

If you gave hime a broken wii then shame on you, though the fact that you posted this thread would suggest you didn't.

I had a similar problem, however it didn't go as far as the police. Just make sure you have the real games that you sold as backups. As far as law attacks, if he bought the backup w/o already owning the real games, he is going to be in some trouble.

hi, it was a downloaded games with the wii and the wii is working before we swaped . The wii was listed on ebay as buy it now, he emailed me first, and I said if no oneone will buy I will agree to swap. No one buy so we did swaped. after 4 days I got an email from him that he wants his psp back and threaten me that he will report to police if I dont give his psp back because my wii is chiped and the games are pirrated.

Well like we said, he knew that when he took it so he is guilty of receiving stolen goods as you are guilty of downloading them.

You are both wrong in the eyes of the law so he would be a fool to do anything.

Tell him when you gave him the wii it was working perfectly, so whatever has happened since is his problem. And also if he does involve the police he will get into as much trouble for owning the games anyway, so he probably won't bother, and if he does he is stupid. It is ILLEGAL to own pirated games as well as to sell/buy them.

what I think is he just realised that he will just buy a wii then get it chiped and copy the games from me and ask his psp back. what do you think?

Maybe. I would let him know that if this goes to the cops, both of you guys will suffer charges. So I would try to make agreement will him. I mean, he was trading for a modded wii and backups. So he knew what he was doing. Maybe he wants to trade back, because he got scared of wii security(HAHA) or he is confused about something. Ask him for a more detailed reason for wanting to trade back.

If not, you can go and buy very game you downloaded :)

As far as the backup laws. It is Illegal to buy or sell the games if you don't own them.

However you are allow to make a backup of a game you don't own, as long as it is destroyed within 24 hours.

I'm willing to exchange it but when I read your adviced not to then I made up my mind not to swap it.I have no intention of scamming the guy. the guy is obviously lying because he bought backup which i don't think he owns, why would he have games instead of the wii? if his brother is a cop then his brother would arrest him. Tell the guy to stop making up stuff and just ignore him. the deal is done, nothing he can do unless you want to exchange it again. But in my opinion DON'T because it looks as if he is trying to scam you.

He sounds like he is full of it. Email him back. And say your peace. Tell him a deal is a deal. If he keep Harassings you, just block him.

Remember if worst becomes to worst. Both will suffer equal charges for the buying/selling of copied games.

Bottom line he made a deal, and if he does want it now, thats his problem. Especially if he had it for four day.

Don't let his guy scare you.
