Okay, so I'm on 3.1E, is there any way I can access the wii shop channel without updating to 3.3? Cheers.

Short answer: No.

Long answer: Anything that can be installed from the shop channel can be installed via the wad loader, so there's really no reason to use the shop channel anymore. Additionally, many of the more recent shop channel apps will only run if you have the most recent firmware, so to run them you'll have to update anyway.
