Chance of new games not working on a banned xbox 360?

I read somewhere on the forums here that if your xbox gets banned, that you will not be able to play some games without an update (that is impossible on a banned system). Is this correct? Are there some games out there that will not even load unless you first update your dash? If your xbox 360 is banned from live, does this mean that you can never play that game on your system?

Just evaluating all the possibilities before i press into modding my firmware...

no that is a lie, how would the xbox know there is an update if there is no live? the update is on the disc.
