xbox live update and flashing new drive question

The board in my xbox 360 disc drive went bad so the only way to replace the drive is to get a new drive and flash it. My question is do I run the risk of getting banned from xbox live if I just plan on flashing the drive to replace it, not download firmware to mod my console. I am weary to do this because of the new update and all of the talk of being banned for having modded firmware. Also, should I update my console first and than flash the drive or flash the drive first and then update?
