xbox live update and flashing new drive question

The pcb booard inside of my xbox 360's disc drive is going out so The only way to replace it is to get a new drive and flash it. My question is do I run the risk of getting banned from xbox live if I just plan on trying to flash the drive to replace it, but not use any firmware to mod my console. Also, should I flash the drive before I get the update, or get the update and then try to flash the drive. Again I just plan on spoofing the drive for now, not running modded firmware. Thanks

yes you can get banned. and the update is already out so that is out of the question.

I know the update is out, but I haven't gotten it yet because I haven't signed into live. You think I should flash the drive before or after?
