if i have 2 xbox 360s and 1 of them is modded and the other 1 isant can my non-modded xbox get banned from live if i use the same hard drive with both of them.

i don;t think so, hdd has nothing to do with backups, but you never know from microsoft.

if i never use the modded xbox on xbox live would there be any record of me playing backups on my hard drive or would there be any way that microsoft could ban me.

if the modded xbox is not going on xbox live then i am 99% sure you will not have problems.
