i dont know but so far if you're old hdd craps out and u have to get a new one you can use the liscence transfer tool from MS, its free, and all you need is a new hdd and your gamertag linked to your Windows Live ID

Why? If you're using the same gamertag, you can download files you have previously purchased as many times as you like.

Well the 360 doesn't allow you to actually see those individual files and copy them, so backing them up is probably not possible without bypassing your 360...

...but once you have downloaded content from the Marketplace, you are able to download it again... as many times as necessary. Which means that you can slap in or hook up a 2nd hard drive to your 360 and download the content again to that other drive... hence having a "backup copy".

What I was merely stating is that you do not need to backup those files since you can download them again, free of charge.

You both can and can not. It depends on the content. If it's content which is free like demos, that can be backed up, though it's not a simple process for most people.

If it's purchased content, that get "signed" to your account. It may be possible to resign content like some do with gamesaves, but I haven't heard anything about it.
