Game will not exit when HOME is pressed issue.. please help.

Anyone else run into this issue? Basically when I need to exit a game and press the home screen, I'm unable to scroll over using the right or left buttons to hit yes or no.

It's not a hardware issue as the left and right keys work during the game.

I'm on a phat cfw 500m33_4
