ok so im getting my xbox back tomorow morning if all i got is a flashed drive and im not cheating in any way could i still get banned? as im not cheating , the xbox live terms and services says ' will not cheat using a modded console' or whatever it is and im not cheating , so could i get banned still.

bypassing/circumventing copyright protection is classified as cheating, so yes.

would i deffinately get banned after some time,or like there a chance cuz my uncles mate has live with a modded box and he has nt got banned yet and has had it for a while?

Nobody is sure how MS detects and then bans modded box's, some people have been banned within weeks of modding there console and some have yet to be banned after months/years.
