Console ban or Account ban??

Okay something else i have noticed is stirring confusion is whether or not getting a modded console detected will incur an Account ban or a Console ban?
I'd love to know what exactly gets banned...if its a console ban then obviously having 2 xbox 360's kinda solves that prob as one can be used for backups and one for online play.
If its an account ban then it'd be better me paying for xbl monthly from now on just incase the worse happens, rather than paying for a whole year then getting banned and being out of pocket...what do you guys think?

P.S. I know its not a case of IF i'll be banned, but more a case of WHEN.

Console ban for playing back-ups online. Gamertag ban for stuff like boosting.
