ok i have asked this question in another thread before but somebody asked another question straight away and it got overlooked.
as of right now i am on xbox live with 1.50 firmware. if i was to patch a game lets say UFC..to wave 2 could i play it on my xbox 360 without the modem cable plugged in THEN go back on line and play lets say COD 5 without fear of getting banned?.What im saying is will my console store information offline in my HD about a patched game and then release it to microsoft the minute i go online?

Nobody knows for sure how MS detects backups and copies, but what we do know is playing wave 3--2 patched games increase your likelihood to be banned by 10x maybe.

Now you could play these games 500 times and maybe never get noticed but you might play it one time and MS will catch you, cause the patch can be detected.
In truth we never really know why someone has been banned as MS doesnt give a reason but enough people have been banned playing patched games to make it more than co-incidental.

you should just bite the bullet and upgrade to 1.6

You should look into doing it yourself, its really not as complicated as it seems, but i understand alot of people dont have the time or confidence to do it for themselves. But really if not getting banned is important to you, you should regularly upgrade to the latest firmware and avoid patching.

1. A compatible S-ATA Chipset (Onboard sometimes works, if not, the VIA S-ATA card with the 6421 chipset0.
2. 32-bit Operating System if you are going to use a program like Jungle Flasher. (PortIO driver + .Net framework 2.0 or higher).
3. A bootable jumpdrive if you prefer programs like DosFlash or iPrep.
4. If a newer 360 with the Lite-ON drive, you will need a key reader like the CK3 Probe or the Maximus Spear. Homemade can work too.
5. S-ATA cable. DVD connectivity kits make it easier to power the drive rather than using the XBOX 360 to power the drive.
