Infringemet Letter From ESA HELP!!!

Hi I've been downloading backups to my 360 games using sites like IsoHunt and BTJunkie, I recently recieved an email regarding infringemnet from my ISP. Do I have anything to worry about?
Does the ESA ever press charges? And is there any safer ways to download backups such as usenet and newsgroups?

No technically you cant get in trouble, they might try to strong arm you a fine, but dont pay, if they go to court and assuming your in the USA theres not much tehy can do unless they prove otherwise beyond a reasonable doubt you download games and sell them, so if you do, NOT saying you are, dont sell anything over the summer.

I think your probubly using a cheap news services,DO u use giga news? if so are you paying for extra encrption? You might want to look into it.

Other then that theres not much they can do to you except limit your bandwith and or lower your monthly usuage of uppload/download etc.

This reply is so full of fail it made me giggle. Technically he can't get in trouble? What the hell are you smoking, I want some! And what is all this bs about selling pirated games? Kind of sounds like you do that by inducing he does from his post....if you do you deserve to get raped by the ESA.

You were obviously in a swarm that consisted of the ESA. They caught your ip along with all others in the swarm, whois'd you and proceeded to send a DMCA take down request to your ISP. By law, your ISP must forward the letter to you, or they can be found liable for your actions. Typically, if this is your first offense, you will receive a warning. If you must, reply to your ISP stating that the material in question is no longer present. It would probably be in your best interest to stay far the hell away from public bit torrent sites, or better yet, stop downloading games altogether.

Guess you learned a lesson, huh?

Use Peerguardian 2 which contains a black list of IPs. I have never had a problem.

I agree use peerguardian, and if you want use newsgroups with Grabit, not many game selections though. also: www.xbox360iso.com is an EPIC website for games, I love it.

damn, i forgot about the no links rule.. not sure if the site i mentioned counts as that though. I don't know how to remove it if it's wrong, can someone verify if it's okay with that site or not? its a good website though, just trying to help.

The rules on this site are weird. As long as you don't give a direct link to a game you're fine. One rule says don't do this and another one says it's okay to. Depends on how picky the mods are.

Relying on PG2 to save your ass is foolish. If anybody thinks media sentry/media defender/ESA/MPAA/RIAA use a static range, well you get what you deserve. PG2 is the best definition of false security ever. I agree, it does its job well in the sense that it blocks know ip ranges. The problem is though, these major agencies can easily get a new ip any time they desire...what will protect you then?

There is a magical button on your reply known as the edit button. Like gameover said, the rules are fuzzy. I don't think that url will get you in trouble.

it certianly isn't foolproof, but it's also dumb to think it is worthless. PG2 is worth having, but don't rely on it for complete anonymity.

This post tells you everything you need to know but i would add that is unlikely you will get in any trouble from this, mainly because there are too many big fish to catch first before they will go suing you for downloading 2 games.

However as been said you need to lay low, try different trackers to the ones u been using, try newsgroups or dont download at all because now you know you are being watched

I got this type of letter back in 2005 for downloading the movie, The Grudge using bittorrent. It scared the crap out of me so after that I didnt use anymore P2P application. I started using mIRC.....then got fed up with the wait times and started using newsgoups for everything.

Has anybody ever heard of someone getting a letter from downloading using newsgroups though? I've always wondered about this and done searches but cant find any instances.

i use newsgroups and recieved a letter off my isp regarding downloading..they didnt name anything in specific just the amount i was downloading so i backed off for a while and have never heard anything since..maybe i wasjust lucky to get a caution..not sure

nope, cause its only between you and your news server provider, but yeah i guess you could piss off your isp for excessive downloading

Thanks for the input, whats your ISP, news provider, and how much exactly did you download? I use ATT, giganews, and the most I've downloaded was 250 gigs in one month, I'm usually around 50-100 every month but I havent heard any complaints.

Hopefuly that is the case, but I been wondering how long will this newsgroup venue last before they start targeting it......you would think that all the RIAA folks are fully aware of newsgroups...also maybe the amount of people using them may not be substantial enough yet due to the need to be kinda tech savvy to use them.

Well usenet has been around longer than the world wide web, its older than most people who post here probably.

Its almost impossible for anyone to tell where a newsgroup upload came from and its virtually impossible to remove content from usenet since it hosted on so many different servers, a company would have to send 100 hundreds of takedown notices everyday to just keep up and it still wouldnt work.

Its ironic that the oldest of technologies is most difficult to stop

I remember a while back reading an article here that a bunch of pedo's were busted using usenet to share kiddie porn. There was another article that was more recent, but I am having trouble locating it.

From what I understand, usenet is SSL encrypted, right?

are you talking about the usenet as a whole or the actual usenet.com? i know alot of providers do ssl these days but i'm not sure about usenet.com.

i don't remember reading that pedo's were busted but i remember reading that some isp's were getting alot more strict because of the kiddy porn scene.

Anywhoo, stop worrying, if you do your search, and the article was on here, but the RIAA, or what ever they are called are not going to do lawsuits anymore, they are making arangements, and comcast is the 1st, time warner is following suit, to limit bandwith per month, so obviously if your grabbing 200 gb a month they know your downloading, so they will just cap it.

I could be downloading linux distro's, burning them and giving them out freely to people on the street for all they know, i've never been caped by my ISP and if they ever tried i would switch ISP's in a heartbeat

There have been some issues with people distributing child porn over usenet and some people have been arrested for it. Many ISP's have blocked user access to certain usenet groups after pressure from different lobby groups and also to limit the amount of bandwidth their customers use.

Usenet is just a named used to describe a network of computers which store information which can then be downloaded. It in itself has no form of encryption, however many news providers offer their customers SSL connections to their servers for maximum privacy and security.

I got this letter a few months ago for downloading quantum of solice, It was downloaded from a torrent site, cant remember which one,they told my it had been cut off because of the illegal downloading of copyright material, i totally shit mysef, they temporarily terminated my internet connection until i signed a letter saying i wouldnt do it again, since then i havnt used the torrents but dl all my games from xbox360iso.com, havnt heard anything since, i think they get you by the uploading part( SEEDING), after all you can download a backup of a game as long as you own a legit copy(WINK WINK)

I am not sure where you live, but that is false in the US. The DMCA says you are allowed to backup what you own BUT, you cannot circumvent copyright protection while doing so. In the eyes of the law, backing up anything you own, whether it be a cd or a game, is illegal thanks to the worthless DMCA.

I spent an entire semester while in college studying this nonsense....worst experience of my life.
