Thought I'd just point this out:

Phillips has developed DVD9-R disks, though they don't seem to be available on the mass market just yet.

BenQ has a burner that they claim will be upgradeable to burn DVD9 disks; Model name is DW822A DVDReWriter

CloneDVD claims to be able to handle DVD9s, but I don't know if their program simply splits the layers or has the ability to create a 1:1 copy.

In any case, a 1:1 DVD9 copy should work just as well as an original disk (I backed up my WarCraft 3 CD-R 1:1 that way, rather than being forced to find a crack if the original was destroyed) In the same way, unless the laser can tell the difference, an identical stream of 1's and 0's flowing from the disk in your Xbox should allow you to bypass the nasty warranty-voiding process of modding and allow you to use backup copies within the drive itself.

If anyone can find a source for either Taiyo Yuden, Phillips or Verbatin DVD9s, please make it known. These are the companies involved in writeable DVD9 development.
